If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. We may amend these Terms from time to time. We will notify you of any material amendments. Every time you wish to use our Site, please check these Terms. We operate this site for the purpose of promoting and selling the products and services supplied by us.
ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, or that you are the age of majority in your country of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach or violation of any of the Terms will result in an immediate termination of your Services.
Whilst we take steps to ensure the accuracy of the information accessed via this site, we cannot guarantee or give any warranty as to the accuracy, timeliness or completeness of any information or material appearing on it. We have no responsibility for content provided by third parties and are merely providing access to such content to you. We have no obligation to verify the content of such information nor to edit any such information provided by third parties. We do not endorse, support, represent or guarantee the truthfulness, accuracy, or reliability of any third party details and you acknowledge that any reliance on such information will be at your own risk.

We accept no liability for functions contained on the site and make no warranty that the site will operate uninterrupted or error-free or that any defect will be corrected. We do not warrant that the site is compatible with your computer equipment or that the site or its server is free of errors, viruses, worms or "Trojan horses" and we shall not be liable for any damage you may suffer as a result of such destructive features. If any provision of these conditions is or becomes invalid or contravenes applicable regulations then the remaining provisions will not be affected.
Websites or pages to which this site is linked (other than other websites operated by us) are for information only and have not been reviewed by us. We have no responsibility for the content of such websites or pages and accept no liability for any losses whatsoever that may be incurred as a result of any linking to the same.
All food and cleaning products listed for sale on our site are provided from external companies located within Northern Ireland. Lists of used ingredients, agents and allergens is required to be found through the providing company and will not be issued through Fig Tree Lane. Where possible, we will provide specific information available about the products on our website, however full and accurate details should always be sourced directly from the providing company. Fig Tree Lane takes no responsibility for products purchased from our listed external companies in regard to ingredients used or come into contact with, expiry or best before date information, or allergy related information.
All items shown on the Fig Tree Lane ‘Second Chance’ shop page, unless otherwise mentioned, are second hand. We hand check all of our items to ensure a good level of quality and condition.
Any items listed for sale through our local vendors sale page are provided directly by the external company listed and are not the responsibility of Fig Tree Lane. We do not take responsibility for incorrect, damaged or lost products. Any issues or concerns with items purchased through this service and page must be taken up directly with the company listed.
The images of the items on our website are for illustrative purposes only. Although we make every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of an item. Your item may therefore vary slightly from those images. We will not be responsible or liable for any differences between an image and an actual item.
Currency. All prices are in GBP / £ sterling.
The packaging of the product may vary from that shown in images on our website depending on availability.
ORDER PROCESS & OUR CONTRACT WITH YOU
CONFIRMATION OF ORDER
Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between Fig Tree Lane and you (customer). If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is unavailable, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.
We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
NORTHERN IRELAND BASED
Our website is solely for the promotion of our products in the UK. At present we only deliver items to households within Northern Ireland, unless a local vendor has provided shipping details for UK wide postage. We do not accept international orders.
INCORRECT ORDER INFO
We will not be responsible for any loss or damage you may experience if you provide incorrect information during the order process and this leads to the wrong items being delivered or your items being sent to the wrong address.
Fig Tree Lane offers the user an option to create an account through this website to store details of past purchases, wish list items and address details. This is not a credit or payment account. The user is responsible to ensure all account details are accurate and kept up to date. If details are inaccurate or need to be modified, you must contact Fig Tree Lane immediately to amend these changes. If you have set up an account, a confirmation email will be sent to the registered email address. Upon registering for an account the user will need to select a password. It is the responsibility of the user to keep this password confidential. The user will be held responsible for all activities that occur under their account. If the user suspects their account is being used by another individual they must immediately change their password using the ‘Forgot Password’ link on the log in page. If Fig Tree Lane has reason to believe that there is likely to be a breach of security or misuse of the Fig Tree Lane Shop Website, we may require you to change your password or we may suspend or cancel your account. The auto login facility is provided for your convenience. If you enable it, you remain liable for all activities and orders which are submitted to your account. You should therefore only enable auto login on your machine if you are sure that it will not be misused by anybody else. We do not advise enabling auto login if you use a shared computer.
Each Product for which you click 'Add to basket' is added to a 'shopping basket' facility. You are given the opportunity to review the quantity and frequency of order of each item in your shopping basket when you choose to view your basket details by clicking or tapping the basket icon, or clicking 'go to checkout'. You can change these, or cancel the purchase of each of the Products completely, at this stage at any time before clicking 'Checkout'. After you have clicked 'Checkout' and after our acceptance of your order, items are added to your delivery in addition to any items that you have previously ordered. The Website still allows you to review all the Products that you have already ordered from us, and make amendments and corrections to them until the deadlines published on the Website. Your submission of an order amounts to an offer to enter a contract to buy the Products from us; you cannot then withdraw or cancel your order without approval via written contact from a member of Fig Tree Lane staff.
OUR RIGHTS TO END THE CONTRACT
We may end the contract for a product at any time by writing to you if:
(a) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the products;
(b) you do not allow us to deliver the products to you within a reasonable time or collect them from us within 7 days of the date on which we inform you the order is ready for collection.
(c) We do not receive approved payment from you on placement of order.
DELIVERY OF PRODUCTS
We will make delivery to your address as stated when you make a purchase, set up an account or update your address. We reserve the right not to deliver to all locations. If your address is located outside of Northern Ireland you are automatically ineligible for delivery. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability, and will consider the offer of compensation at our discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal. Any changes to address details must be made before the order deadlines published on our Website.
We endeavour to keep your delivery day the same, but we reserve the right to change it temporarily or permanently and will tell you if we do so.
If we are unable to deliver to you, or have to deliver late, for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss that this causes. We will not charge for Products unless or until we have delivered them to you.
Upon delivery you must inspect the goods for any incorrect items and inform Fig Tree Lane within a 24 hour period via phone (+447 842 092 287) or email (email@example.com) to have the issues rectified.
You are able to cancel your account or ongoing subscription service with Fig Tree Lane at any time through your account online or by contacting us in written form at firstname.lastname@example.org
Please note that any cancellation of a subscription service requires a 5 day notice period. If a regular delivery day is included within the 5 days from your cancelation notice, the regular product delivery will still occur and you will be held liable to pay for the products delivered. If you need to cancel an order placed for grab and go grocery items you must contact us immediately via phone or email. If the item has already shipped or is out for delivery you will be held responsible for payment. If you need to cancel an order made through a local vendor you must contact us within 24hours. If this amount of time has passed you must contact the vendor directly via their listed contact details. If the cancellation is accepted by Fig Tree Lane we will confirm via written email and issue a refund to be processed within 10 working days.
The price of the product will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the product advised to you is correct. We accept payment using VISA, Mastercard and PayPal. You must pay for the products before we dispatch them. We will charge you at the time you place your order. If you think an invoice is wrong please contact us promptly to let us know.
If you have selected an ongoing subscription product: Fig Tree Lane Shop will be operating through WIX payments subscriptions, so you will be billed a recurring set price for your product until such a point as the contract is cancelled. We also offer a payment service of cash on delivery for subscription boxes only. If you would like to set up a cash payment system, please call our team at +44 7842 092 287 to finalise.
The total amount in your online basket must be paid upon ordering.
We accept payment with:
Credit or debit card (Visa or MasterCard);
Offline payment (cash)
If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any associated delay or non-delivery.
Payment information is stored within our systems for administrative purposes; we do our utmost to ensure the security of these details. Your full payment card details are encrypted, stored and processed by a fully PCI compliant third party provider, and are inaccessible to any Fig Tree Lane staff or any other third party. We use your payment information when you purchase with us to enable automatic payment for regular orders.
You are entitled to cancel a payment for Products where fraudulent use has been made of your payment card by a person not acting, or to be treated as acting, as your agent. If you have already made a payment where your payment card has been so fraudulently used, then you should approach your card issuer for recredit to your card.
OUR RESPONSIBILITY FOR DAMAGE SUFFERED BY YOU
We are responsible to you for foreseeable damage caused by us. If we fail to comply with these Terms, we are responsible for any damage you suffer that is a foreseeable result of that failure or of our failure to use reasonable care and skill. Damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen. We are not responsible for any damage that is not foreseeable.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights including the right to receive items which are: as described and match information we provided to you; of satisfactory quality; fit for any particular purpose made known to us; and supplied with reasonable skill and care. However, to the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to items you order from us.
We are not liable for business losses. We only supply items for domestic and private use. If you use our items for any commercial, business or re-sale purpose we will have no liability to you for, without limitation, any loss of profit, loss of business, business interruption, or loss of business opportunity.
OTHER IMPORTANT TERMS
When you become responsible for the goods: An item will be your responsibility from the time we deliver the item to the address you have provided us.
When you own goods: You own an item once we have received payment in full.
Nobody else has any rights under this contract. This contract is between you and Fig Tree Lane Shop. No other person will be able to enforce any of its Terms. Neither of us will need to get the agreement of any other person to end the contract or make any changes to these Terms.
WHICH COUNTRY’S LAWS APPLY TO ANY DISPUTES?
These Terms, their subject matter and their formation, are governed by English law. You and we both agree that we will both first attempt to settle any dispute by negotiating in good faith, failing which the courts of England and Wales will have exclusive jurisdiction, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland.
WE MAY SUSPEND OR WITHDRAW OUR SITE
Our Site is provided on an ‘as-is basis.’ We do not guarantee that our Site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons.
SITE SECURITY AND VIRUSES
We do not guarantee that our Site will be secure or free from bugs or viruses. You should use your own virus protection software. You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. Fig Tree Lane notes that while website services will meet your requirements, we cannot guarantee that the service will be fault free. If a fault occurs in the service, please report it to us and we will correct the fault as soon as we reasonably can. Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will restore the service as soon as we are able. In the event that our Website is unavailable, our usual order and cancellation deadlines apply; please notify us of changes to your order.
